SEC Issues Climate Change Reporting Demand

Although cap and trade legislation is stalled, the SEC has determined public companies are nonetheless required to consider "climate change" disclosures in their public filings. In a 3-2 party line vote, the SEC adopted a “Guidance Regarding Disclosures Related To Climate Change.” Notably, the guidance requires reporting companies to consider both “reputational risks” and the "impact of physical events from climate change."
